Legislation Introduced to Incorporate Public Transportation Into Local Planning and Zoning

House Bill 5211, introduced by Representative Donigan, would amend the Michigan Zoning Enabling Act to include consideration of public transportation in zoning plans.  Under the current Act, a zoning ordinance must be based on a plan designed to facilitate sewage disposal, water supply, education and recreation, among other goals.  The Bill would amend the list of provisions to include public transportation.  The amendment would only apply to a plan adopted or substantively amended more than 90 days after the Bill's effective date.

In a similar fashion, House Bill 5212 would include public transportation into the municipal planning process.  The Michigan Planning Enabling Act requires a master plan to include certain subjects that can be reasonably considered pertinent to the future development of the planning jurisdiction.  The Bill would add public transportation to that list of subjects.  Again, this amendment would only apply to a master plan that was adopted or substantively amended more than 90 days after the Bill's effective date.
